Updated Illinois Child Custody Laws
Illinois child custody laws underwent changes that involved new terminology as well as how child custody determinations are made by family law courts. As of January 1, 2016, legal terms, including custody, custodial parent, and visitation, have been removed and new terminology has been included, such as allocation of parental responsibilities, parenting time, parental plans, and others.
The new guidelines in the Illinois Marriage and Dissolution of Marriage Act (IMDMA) has ended the sole and joint custody clause, and introduced co-parenting, where both parents have to take part in raising the child to some extent. The court will assign one or both parents different categories of responsibilities, such as medical, religion, education, and extracurricular activities, based on the needs of their children. All child custody determinations will be included in a comprehensive legal document called the parenting plan.
